Mark is the co-founder of Astor Simovitch Law and The Mental Health & Addiction Law Firm, where he focuses on legal issues involving severe mental illness, substance use disorders, involuntary commitment, guardianship, and family intervention. He has helped hundreds of families navigate behavioral health crises and pursue appropriate treatment options for loved ones.

Abstract

Substance use disorders often create complex legal challenges for individuals, families, treatment professionals, and behavioral health providers. Understanding the legal options available during a substance use crisis can be critical to protecting an individual’s rights while also helping families navigate situations in which voluntary treatment has been unsuccessful.
This presentation will provide an accessible overview of the legal framework surrounding substance use intervention with particular attention to the Marchman Act and other legal mechanisms that may become relevant when an individual is experiencing a serious substance use disorder. The presentation will explore the circumstances under which involuntary assessment and treatment may be pursued, the role of families and treatment professionals, and key procedural considerations throughout the process.
Mr. Astor will also discuss common legal questions that arise when families are attempting to obtain help for a loved one, including questions concerning confidentiality, consent, capacity, due process, and the rights of individuals involved in involuntary treatment proceedings.
Particular attention will be given to the distinction between providing appropriate legal intervention and ensuring that individuals receive treatment in a manner consistent with their legal rights.
Through practical examples and discussion of Florida law, attendees will gain a clearer understanding of how the legal system intersects with addiction treatment and behavioral health care. The goal is to equip professionals with information they can use when collaborating with individuals, families, attorneys, and treatment providers during substance use crises and to encourage more informed, legally appropriate approaches to connecting individuals with care.
